SUMMER PROMOTION: Flat Fee for Uncontested Probate Applications
At Pax Law Corporation, we understand that dealing with a loved one’s estate can be a challenging and emotional process. We aim to ease the burden by offering transparent, reliable, and affordable legal support for probate applications.
From June 30 to August 15, 2025, we are offering a discounted rate by way of a flat legal fee of $2,000 (not including taxes and disbursement) for uncontested probate application services.
What Is an Uncontested Probate Application?
A probate application is the legal process that verifies a Will is real or valid under B.C. laws and a necessary step to obtain a court document also known as a ‘grant’ that says an individual have been legally proven to be the executor named in the Will.
An application is considered uncontested (or “non-contentious”) if:
- There is a valid Will, properly signed and witnessed,
- The named executor is available and willing to apply for probate,
- No one is disputing the Will’s validity, the appointment of the executor, or the entitlement of the beneficiaries,
- All required parties (beneficiaries, intestate heirs, etc.) are properly notified and have no objections.
Uncontested probate is typically a paper-based application to the Supreme Court of British Columbia and does not involve a court hearing.
Who Qualifies for Our Promotion?
This summer promotion applies to uncontested probate applications that meet the following criteria:
- The client retains our estates lawyer, Shona Thomas, between June 30 and August 15, 2025.
- The estate is located in BC and the Will is being probated under BC law.
- There is a valid Will and the executor named in the Will is applying.
- There are no disputes or anticipated challenges from family members, beneficiaries or other interested parties.
- All beneficiaries and required parties can be located and properly notified.
- All required estate documents (such as the original Will, death certificate, and asset information) are available.
What is Included in the Flat Fee?
This limited-time promotional rate covers the following legal services:
- Drafting and issuing the Notice of Proposed Application in Relation to Estate to all interested parties.
- Drafting the Submission of Estate Grant, Affidavit of Application, Affidavit of Delivery, Affidavit of Assets and Liabilities
- Conducting a Wills Search and obtaining a Certificate from the Chief Executive Officer under the Vital Statistics Act
- Overseeing the signing of the relevant probate documents and filing the probate application at the Probate Registry.
Our team will guide you through the formal steps necessary to begin the probate process, ensuring legal compliance and efficient handling of your application.
What is Not Included in the Flat Fee?
The following are not included in the promotional flat fee and will be billed separately:
- Initial consultation fee
- Court filing fee
- Probate fees (calculated by court based on gross value of estate)
- Disbursement costs (e.g. cost of conducting searches, courier charges, printing costs etc.)
- Taxes (GST/PST where applicable)
If your probate matter involves additional complexities, such as out-of-province assets, contested Wills, disputes between family members or beneficiaries, we may quote additional legal fees after consultation.
