IRGC Military Service Defence Lawyers in Canada

If you completed mandatory military service in Iran and were assigned to the Islamic Revolutionary Guard Corps (IRGC), an IRCC or CBSA officer may say you are inadmissible to Canada on security grounds under paragraph 34(1)(f) of the Immigration and Refugee Protection Act (IRPA). This can affect visitor, study and work applications, permanent residence, refugee claims and citizenship.

Pax Law Corporation represents former conscripts at every stage, from the first procedural fairness letter to the Federal Court of Canada. Our lawyers advise clients from our offices in North Vancouver and Toronto.

How we defend IRGC conscription cases

Stage 1
Respond to the procedural fairness letter (PFL)

A PFL is your chance to answer the officer’s concerns before a decision is made. We review your service records and earlier statements, prepare a detailed sworn declaration and supporting evidence, and file written submissions on the legal test for “membership”.

Professional fee: $4,000 (one written response)

Stage 2
Reconsideration after a refusal

If your application is refused, we obtain and review the officer’s notes (GCMS) through an access-to-information request and, where the record shows an error or new evidence is available, ask IRCC to reconsider the decision.

GCMS/ATIP request: from $500 · reconsideration quoted after file review

Stage 3
Judicial review at the Federal Court

An Application for Leave and Judicial Review asks the Federal Court to set aside an unreasonable or unfair decision. Strict filing deadlines apply: 15 days after you are notified of a decision made in Canada, and 60 days for a decision made outside Canada.

Professional fee: from $3,000

Other IRGC-related matters we handle

  • Section 44 reports and Immigration Division admissibility hearings – professional fee from $6,720.
  • Ministerial relief under section 42.1 of IRPA – professional fee from $8,960.
  • Security screening delays – a demand letter and, if needed, a mandamus application at the Federal Court, from $2,500. See our stuck file and mandamus page.
  • CBSA interviews about military service, and refugee claims affected by IRGC allegations.

Fees are flat professional fees for ordinary matters, as set out in our retainer agreement. Government fees, translations and other disbursements are extra. No lawyer can guarantee an outcome; every case depends on its own record and the applicable law.

What to do now

  1. Do not ignore a PFL or a CBSA letter, and note the deadline in it.
  2. Gather your military service card, discharge papers and any document showing your unit, duties and dates.
  3. List every application you have made to Canada or another country.
  4. Book a consultation before you send any response or attend another interview.
