When someone passes away, the process of confirming their will and appointing the executor—known as probate—is intended to be straightforward. However, disputes do often arise.
What Is a Probate Dispute?
A probate dispute is a legal disagreement concerning the validity, interpretation, or administration of a will during the probate process. Disputes can involve the following issues:
- Competing wills
- Allegations of undue influence, coercion, or fraud
- Claims that the deceased lacked mental capacity at the time the will was signed
- Improper execution or witnessing of the will
- Ambiguities or contradictions in the will’s language
- Challenges to the appointment of the executor
- Objections to granting probate based on suspicious circumstances
Probate disputes are governed by the Wills, Estates and Succession Act (WESA) and fall within the jurisdiction of the Supreme Court of British Columbia.
