Therefore, it applies to residential tenancies within British Columbia. The RTA is meant to regulate the landlord-tenant relationship. It is not an Act to exclusively protect landlords or tenants. Instead, it is a law meant to make it easier and more economically viable for landlords to enter into rental agreements in the province of British Columbia. Similarly, it is an Act to protect some rights of tenants while recognizing the valid property interest of landlords.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0709814 elementor-widget elementor-widget-heading\" data-id=\"0709814\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What Is a Residential Tenancy under the RTA?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6fb77229 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"6fb77229\" data-element_type=\"widget\" data-e-type=\"widget\" residential tenancy asL:<\/p>\n<p id=\"d2e601\"><em><strong>2<\/strong>\u00a0\u00a0\u00a0(1) Despite any other enactment but subject to section 4\u00a0[what this Act does not apply to], this Act applies to tenancy agreements, rental units and other residential property.<\/em><\/p>\n<p><em>(2) Except as otherwise provided in this Act, this Act applies to a tenancy agreement entered into before or after the date this Act comes into force.<\/em><\/p>\n<p><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/02078_01#section2\" target=\"_blank\" rel=\"noopener\">https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/02078_01#section2<\/a><\/p>\n<p>However, section 4 of the RTA sets out some exceptions to section 2 and explains in what circumstances the landlord-tenant relationship will not be regulated by the Act:<\/p>\n<p><i>4 This Act does not apply to<\/i><\/p>\n<p><i>(a) living accommodation rented by a not for profit housing cooperative to a member of the cooperative,<\/i><\/p>\n<p><i>(b) living accommodation owned or operated by an educational institution and provided by that institution to its students or employees,<\/i><\/p>\n<p><i>(c) living accommodation in which the tenant shares bathroom or kitchen facilities with the owner of that accommodation,<\/i><\/p>\n<p><i>(d) living accommodation included with premises that<\/i><\/p>\n<p><i>(i) are primarily occupied for business purposes, and<\/i><\/p>\n<p><i>(ii) are rented under a single agreement,<\/i><\/p>\n<p><i>(e) living accommodation occupied as vacation or travel accommodation,<\/i><\/p>\n<p><i>(f) living accommodation provided for emergency shelter or transitional housing,<\/i><\/p>\n<p><i>(g) living accommodation<\/i><\/p>\n<p><i>(i) in a community care facility under the Community Care and Assisted Living Act,<\/i><\/p>\n<p><i>(ii) in a continuing care facility under the Continuing Care Act,<\/i><\/p>\n<p><i>(iii) in a public or private hospital under the Hospital Act,<\/i><\/p>\n<p><i>(iv) if designated under the Mental Health Act, in a Provincial mental health facility, an observation unit or a psychiatric unit,<\/i><\/p>\n<p><i>(v) in a housing based health facility that provides hospitality support services and personal health care, or<\/i><\/p>\n<p><i>(vi) that is made available in the course of providing rehabilitative or therapeutic treatment or services,<\/i><\/p>\n<p><i>(h) living accommodation in a correctional institution,<\/i><\/p>\n<p><i>(i) living accommodation rented under a tenancy agreement that has a term longer than 20 years,<\/i><\/p>\n<p><i>(j) tenancy agreements to which the Manufactured Home Park Tenancy Act applies, or<\/i><\/p>\n<p><i>(k) prescribed tenancy agreements, rental units or residential property.<\/i><\/p>\n<p><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/02078_01#section4\" target=\"_blank\" rel=\"noopener\">https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/02078_01#section4<\/a><\/p>\n<p>To summarize the RTA, some of the most important landlord-tenant relationships Unavoidable\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ebda2d3 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"ebda2d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bb7ee63 elementor-widget elementor-widget-text-editor\" data-id=\"bb7ee63\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>If the RTA applies to a tenancy, it cannot be avoided or contracted out of:<\/p>\n<ol class=\"wp-block-list\">\n<li>If the landlord or the tenant did not know that the RTA applied to their tenancy contract, the RTA would still apply.<\/li>\n<li>If the landlord and the tenant agreed that the RTA would not apply to the tenancy, the RTA would still apply.<\/li>\n<\/ol>\n<p><span>It is crucial for parties to a tenancy agreement to know whether or not the RTA applied to their contract.<\/span><\/p>\n<p id=\"d2e848\"><i><strong>5<\/strong>\u00a0\u00a0\u00a0(1) Landlords and tenants may not avoid or contract out of this Act or the regulations.<\/i><\/p>\n<p><i>(2) Any attempt to avoid or contract out of this Act or the regulations is of no effect.<\/i><\/p>\n<p><cite><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/02078_01#section4\" style=\"font-style: normal;\">Residential Tenancy Act (gov.bc.ca)<\/a><\/cite><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc153fb elementor-widget elementor-widget-heading\" data-id=\"dc153fb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Residential Tenancy Agreements\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-baf9ab5 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"baf9ab5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd96305 elementor-widget elementor-widget-text-editor\" data-id=\"cd96305\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The RTA requires all landlords to comply with the following requirements:<\/p>\n<p><i>12 (1) A landlord must ensure that a tenancy agreement is<\/i><\/p>\n<p><i>(a) in writing,<\/i><\/p>\n<p><i>(b) signed and dated by both the landlord and the tenant,<\/i><\/p>\n<p><i>(c) in type no smaller than 8 point, and<\/i><\/p>\n<p><i>(d) written so as to be easily read and understood by a reasonable person.<\/i><\/p>\n<p><i>(2) A landlord must ensure that the terms of a tenancy agreement required under section 13 [requirements for a tenancy agreement] of the Act and section 13 [standard terms] of this regulation are set out in the tenancy agreement in a manner that makes them clearly distinguishable from terms that are not required under those sections<br \/><\/i><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/10_477_2003#section2\" target=\"_blank\" rel=\"noreferrer noopener\">Residential Tenancy Regulation (gov.bc.ca)<\/a><i><br \/><\/i><\/p>\n<p>Therefore the landlord-tenant relationship must be started by the landlord by preparing a tenancy agreement in writing, typed in a font of at least size 8, and including all the required \u201cstandard terms\u201d set out in section 13 of the Residential Tenancy Regulations.<\/p>\n<p id=\"d2e616\"><i><strong>13<\/strong>\u00a0\u00a0\u00a0<a><\/a>(1)A landlord must ensure that a tenancy agreement contains the standard terms.<\/i><\/p>\n<p><i><a><\/a>(1.1)The terms set out in the schedule are prescribed as the standard terms.<\/i><\/p>\n<p><i><a><\/a>(2)A landlord of a rental unit referred to in section 2\u00a0[exemptions from the Act]\u00a0is not required to include the following in a tenancy agreement:<\/i><\/p>\n<p><i><a><\/a>(a)section 2 of the Schedule\u00a0[security and pet damage deposit]\u00a0if the landlord does not require payment of a security deposit or a pet damage deposit;<\/i><\/p>\n<p><i><a><\/a>(b)sections 6 and 7 of the Schedule\u00a0[rent increase, assign or sublet].<\/i><\/p>\n<p><a href=\"https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/10_477_2003#section13\">https:\/\/www.bclaws.gov.bc.ca\/civix\/document\/id\/complete\/statreg\/10_477_2003#section13<\/a><\/p>\n<p>The RTB has prepared a blank form residential tenancy agreement and has made it available for use by landlords and tenants on its website:<\/p>\n<p><a href=\"https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb1.pdf\">https:\/\/www2.gov.bc.ca\/assets\/gov\/housing-and-tenancy\/residential-tenancies\/forms\/rtb1.pdf<\/a><\/p>\n<p>It is our recommendation that landlord and tenants use the form provided by RTB and consult a landlord-tenant lawyer before making any changes to the tenancy agreement they intend to sign.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1c91c5d elementor-widget elementor-widget-heading\" data-id=\"1c91c5d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What Tenants Need to Know About Their Rental However, you should always check to the best of your ability that your landlord is the owner of the unit.
