In British Columbia, the court in 1011173 B.C. The general overarching principle is that a client can change their legal counsel at any given time. Section 30 of the Ontario Solicitors Act states:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-911590c elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"911590c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\u201cIf, after any such agreement has been made, the client changes solicitor before the conclusion of the business to which the agreement relates, which the client is at liberty to do despite the agreement\u2026\u201d\n\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8e7345c elementor-widget elementor-widget-text-editor\" data-id=\"8e7345c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Supreme Court of Newfoundland and Labrador expressed this right even more directly in<span>\u00a0<\/span><em>Estate of P.J.O\u2019N. v. In Ontario, section 8(b) of the<span>\u00a0<\/span><em>Contingency Fee Agreements<\/em><span>\u00a0<\/span>regulation explicitly commands:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-da65899 elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"da65899\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\u201cA solicitor shall not include in a contingency fee agreement a provision that\u2026 prevents the client from terminating the contingency fee agreement with the solicitor or changing solicitors\u201d\n\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-81643b8 elementor-widget elementor-widget-text-editor\" data-id=\"81643b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>In Saskatchewan, the court in<span>\u00a0<\/span><em>One Arrow First Nation v Maurice Law, 2025 SKKB 88<\/em><span>\u00a0<\/span>confirmed that financial penalty clauses designed to prevent a client from changing counsel are completely unenforceable:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a1f69dd elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"a1f69dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\u201cThe penalty provisions\u2026 are not fair or reasonable. They include serious financial consequences to the client for choosing alternate counsel\u2026 the practical reality is that the financial consequences of terminating Maurice may very well prevent the client from doing so.\u201d\n\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fbaa80d elementor-widget elementor-widget-heading\" data-id=\"fbaa80d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Can a Lawyer Terminate the Agreement?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9e4e588 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"9e4e588\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d7b5a6 elementor-widget elementor-widget-text-editor\" data-id=\"2d7b5a6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Yes, but a lawyer cannot do so ambiguously or abandon a client mid-stream. The Court of Appeal of Newfoundland and Labrador in Fitzpatrick v Hefferman, at paragraph 33, outlined the strict rules:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d2b623 elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"9d2b623\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\u201cA lawyer who purports to terminate the solicitor-client relationship before the mandate resulting from the retainer is completed must therefore do so in clear and unambiguous terms\u2026\u201d\n\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-724f7aa elementor-widget elementor-widget-text-editor\" data-id=\"724f7aa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The court added that \u201cAbsent a clear termination by the lawyer, the relationship will be presumed to continue during which time the lawyer will remain under a duty to complete the work.\u201d If a lawyer intends to withdraw, they must explicitly notify the client of what remains to be done, any pressing deadlines, and how the client can protect their interests, as paragraph 29 highlights:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-beb2585 elementor-blockquote--skin-border elementor-widget elementor-widget-blockquote\" data-id=\"beb2585\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t\u201cIf a lawyer takes the position that he or she is unilaterally terminating the professional relationship, that position has to be clearly brought to the attention of the client so that the client can act to protect her interests in other ways.\u201d\n\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-38bc254 elementor-widget elementor-widget-heading\" data-id=\"38bc254\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What Is the Difference Between Contractual Termination and Court Withdrawal?\n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e60c352 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"e60c352\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d8a4822 elementor-widget elementor-widget-text-editor\" data-id=\"d8a4822\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>If active litigation is ongoing in court, terminating the private contract does not automatically remove the lawyer from the public court record.
